Terms and Conditions

• The following Terms and Conditions apply to all bookings made with Intensive Lessons.
  • By booking a course of driving lessons, you indicate that you have read, understood, and accepted these Terms and Conditions and agree to be bound by them.

Definitions

• You: The person named on the booking form as the pupil.
• We, Us, The Driving School, Intensive Lessons: The driving school administering the provision of the driving course, booking the tests, and allocating you to a self-employed subcontractor who is a registered DVSA driving instructor.
• The Instructor: A driving instructor acting on their own or on behalf of a driving school when providing the course.

General Terms

• Non-Refundable Bookings via GroupOn:
  • All bookings placed via GroupOn are non-refundable after the initial 14-day period.
  • GroupOn voucher codes have different pricing tiers depending on your area – you must select the correct tier.
• Course Duration and Hours:
  • Total hours include time for the practical test (typically 2–3 hours) and travel home.
  • Extra hours can be booked if needed and may incur fees.
  • Course completion within a set timeframe is not guaranteed.
• Transport to Theory Test Centre:
  • Counts as part of lesson time and must align with the test schedule.
• Eyesight Test Requirement:
  • Pupils must pass an eyesight test during the first lesson or the course will be canceled, and booked hours forfeited.
• Readiness for Practical Test:
  • Instructor may cancel test if they believe you are not ready. No refund for test fee in such cases.
• Test Fees and Booking:
  • Theory test: £38. Practical test: £97 (weekdays) or £120 (weekends).
  • Extended tests cost an additional £62.
  • Tests can be booked via DVSA for lower fees but with longer wait times.
  • We manage short-notice cancellations and test bookings and may reschedule dates as needed.
• Start Date:
  • Lesson start dates are provisional until confirmed with your instructor.
  • Instructor availability and DVSA backlogs do not qualify for refunds.
  • Once assigned, communication with the instructor is your responsibility.
• Course Completion Timeline:
  • You have 4 months from the selected start date to complete the course.
• Lesson Cancellations:
  • Less than one week's notice forfeits the lesson.
• Additional Hours:
  • Missed or canceled additional hours are charged.
• Breaks During Lessons:
  • Allowed at the instructor’s discretion.
• Inclusion of Breaks and Test Time:
  • Course includes car hire for test and travel to/from meeting points.
• Role of Smart Bookings Ltd:
  • Acts as booking/admin agent. Does not deliver lessons. Earns commission on bookings.

Learning and Testing

• Learning Capability: Course duration is a guide. Extra tuition may be required.
• Practical Test Booking: Requires a valid theory pass number. Courses under 30 hours must start after theory pass.
• Practical Test Availability: Subject to DVSA scheduling. No date guarantees.

Contract and Liability

• Course Contract: Between you and the instructor. Disputes must be addressed directly with the instructor.
• Vehicle Breakdown: Instructor responsible for refunds.
• External Cancellations: No liability for cancellations due to weather, illness, strikes, or recalls.

Logistics and Availability

• Travel and Accommodation: Book only after course confirmation unless home pick-up is included.
• Work Scheduling: Only take time off after confirming schedule with instructor.
• Pupil Illness: Courses may be rescheduled; last-minute cancellations may be forfeited.
• Pupil Availability: You are responsible for completing the course by the test date.
• DVSA Cancellations: You may apply for a refund directly from the DVSA.
• Fuel Price Increases: Increases over 5% may result in additional fees.

Abuse Policy

• Any abuse results in immediate termination and fee forfeiture.

The Course

• Individual Instruction: Courses are one-on-one only.
• Instructor Qualifications: All are DVSA approved.
• Test Availability: No guarantee for test slot before theory expiry.
• Driving Standard: Instructor may cancel test if unsafe, with no refund.
• Vehicle Insurance: Provided by instructor. Documentation available on request.
• Course Transferability: Non-transferable unless approved.
• Unused Lessons: Valid for 1 month at instructor’s discretion, then forfeited.
• Instructor Insolvency: Instructor responsible for completion or refunds.
• Non-Local Instructors: You cover travel and meeting arrangements.
• Switching Instructors: Results in course termination and extra test fees.

Your Obligations

• Meet eyesight requirements (20.5m/67ft).
• Meet DVSA eligibility requirements.
• Complete booking form accurately.
• Disclose any health issues.
• Coordinate schedule with instructor.
• Arrange time off and logistics.
• Attend lessons/tests on time with valid provisional licence.
• Provide theory pass number.
• No alcohol or drugs during course.
• Maintain professionalism. Breaches result in termination and forfeiture.
• Present licence on first lesson or lose fees.
• Theory certificate must be valid for 6 months or a new test is required.
• Pay price differences if delays cause 10%+ increase after 3 months.
• Forfeit full balance if no response for 1 year.
• Notify of unavailability within 48 hours to avoid adjustment charges.

Governing Law

• The contract shall be governed by the laws of England, Scotland, and Wales.
